Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Path Engine mobile application (the "Service") operated by Path Engine ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Eligibility: You must be at least 13 years old to use Path Engine. By using the Service, you represent and warrant that you meet this age requirement.

1. Description of Service

Path Engine is a travel alert and route planning application designed to help users arrive on time for their appointments and events. The Service:

• Accesses your Google Calendar events (with your permission) to help you create travel alerts
• Calculates travel times and routes using Google Maps
• Sends push notifications to remind you when to leave for your destinations
• Allows you to manage and customize your travel alerts and preferences

Target Audience: Path Engine is intended for individuals who want to better manage their time and ensure punctual arrival at scheduled events.

2. Google API Services User Data Policy

Specifically, Path Engine:

• Only requests read-only access to your Google Calendar
• Does not modify, delete, or write to your Google Calendar
• Uses calendar data solely to help you create travel alerts for your events
• Does not share your calendar data with third parties
• Stores minimal calendar information (event time, title, location) securely using Firebase Cloud Firestore only as needed for alert functionality
• Allows you to revoke calendar access at any time through your Google Account settings

3. User Responsibilities and Acceptable Use

By using Path Engine, you agree to:

3.1 Appropriate Use

• Use the Service for personal, lawful purposes only
• Provide accurate information when creating travel alerts
• Not use the Service in any way that violates applicable local, state, national, or international law
• Not attempt to interfere with or disrupt the Service or servers

3.2 Prohibited Activities

You agree NOT to:

• Abuse, harass, threaten, or intimidate other users or our support team
• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems or software to extract data from the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Transmit any viruses, malware, or malicious code
• Impersonate any person or entity

3.3 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

4. Disclaimers and Limitations of Liability

4.1 Service "As Is"

Path Engine is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Accuracy of travel time calculations
• Reliability of notifications
• Uninterrupted or error-free service
• Fitness for a particular purpose

4.2 No Liability for Missed Events or Late Arrivals

Important: Path Engine is a tool to assist with time management, but we cannot guarantee:

• Accurate travel times due to unpredictable traffic, weather, or road conditions
• Timely delivery of notifications due to device or network issues
• That you will arrive on time for your appointments

You are solely responsible for arriving on time to your appointments and events. We are not liable for any consequences of missed appointments, late arrivals, or failure to receive notifications.

4.3 Data Loss and Service Interruptions

We are not liable for:

• Data Loss: Loss of travel alerts, settings, or other data due to technical issues, service maintenance, or account deletion
• Service Interruptions: Temporary unavailability of the Service due to maintenance, updates, or technical difficulties
• Third-Party Services: Issues with Google Maps, Google Calendar, or other third-party services that affect Path Engine functionality
• Device Issues: Problems related to your device, operating system, or network connectivity

4.4 Limitation of Damages

To the maximum extent permitted by law, Path Engine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Lost profits or business opportunities
• Loss of data or information
• Cost of substitute services
• Personal or professional consequences of missed appointments

4.5 User Backup Responsibility

While we implement reasonable backup procedures, you are encouraged to maintain your own records of important appointments and travel information outside of Path Engine.

5. Termination and Account Deletion

5.1 Termination by You

You may terminate your use of the Service at any time by:

• Uninstalling the Path Engine application from your device
• Requesting account deletion by emailing mkinnander@bteamsoftware.com with the subject line "Path Engine Account Deletion Request"
• Revoking Google Calendar access through your Google Account settings at https://myaccount.google.com/permissions

5.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for:

• Violation of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons

5.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• Your account and data will be deleted in accordance with our Privacy Policy
• All provisions of these Terms which should survive termination shall survive, including disclaimers and limitations of liability

5.4 Data Retention After Termination

For details on data retention and deletion, please refer to our Privacy Policy. Your account and personal data will be permanently deleted within 30 days of your deletion request.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Path Engine. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

7. Changes to Terms of Service

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

8. Privacy Policy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Third-Party Services

Path Engine integrates with third-party services that have their own terms and policies:

• Google Calendar: Google Terms of Service
• Google Maps: Google Maps Platform Terms
• Firebase: Firebase Terms of Service

Your use of these services through Path Engine is subject to their respective terms and policies.

10. Indemnification

You agree to indemnify, defend, and hold harmless Path Engine, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property or privacy right
• Any consequences of missed appointments or late arrivals while using the Service

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Iowa, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

12. Dispute Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting us at the email address provided below.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Path Engine regarding the use of the Service and supersede any prior agreements.
